WHAT ARE APOSTILLE SERVICES, AND HOW DOES APOSTILLE AND CONSULAR LEGALISATION IN HUNGARY DIFFER FROM THAT IN OTHER COUNTRIES?
An Apostille is a government-issued certificate that must be added to certain documents before it can be used in an official capacity overseas. Officials of any country recognising the Apostille of the issuing country will then accept the documents at face value. If a country does not officially recognise the Apostille of the issuing jurisdiction, Embassy or Consular Legalisation may be required. Each embassy or consulate has different requirements, and it is generally advisable to leave Consular Legalisation to the experts. Hungary is a signatory of the Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents of 1961. That means Apostille certificates issued by Hungary should be accepted without question by other signatory nations, and Hungarian officials should likewise accept Apostille certificates from other signatory nations.
WHAT DOCUMENTS CAN BE APOSTILLED IN HUNGARY FOR USE ABROAD, AND WHAT ARE THE MOST COMMON DOCUMENTS FOR WHICH APOSTILLE LEGALISATION IS USED IN HUNGARY?
Regulation (EU) 2016/1191 has eliminated the Apostille requirement for translations of common public documents like certificates of criminal records, as well as birth, marriage, and death certificates. This is effective throughout the EU, and until it is repealed or replaced, this will still apply in the United Kingdom of Great Britain and Northern Ireland. However, Hungarian Certified Translation especially notarised translation is still widely used in Hungary and the EU
Documents that may require Apostille services for non-EU Hague Convention signatories or Consular Legalisation for non-signatory nations include:
– Birth Certificates and similar vital records from Hungary
– Certification of Family Status
– Private Documents issued by Ecclesiastical Institutions
– Documents Concerning Guardianship or Acknowledgement of Paternity
– Documents Issued by a Chief Veterinary Officer
– Documentation of Criminal Record or Lack Thereof
– Police Reports
– Medical Reports
– Income Certification
– Certificate of Residency
– Primary and Secondary Education or Degree Certificates
– Documents issued by Civil Law Notaries
– Abstracts of Title from the Title Register
CONSULAR LEGALISATION OF DOCUMENTS IN EMBASSIES IN HUNGARY
Documents issued by countries that do not recognise the Hague Convention or Regulation (EU) 2016/1191 can be more difficult to use in Hungary. They will require not only Apostille legalisation but also Consular Legalisation. First, the document has to be legalised by Hungarian Apostille and then the Department of Consular Affairs and Citizenship of the country in question conducts Diplomatic Legalisation of the documents. In all, the documents must first be legalised by the Ministry of Foreign Affairs and Trade. They can then be legalised by an accredited mission from that country in Hungary. In a few cases, documents will require Intermediate Legalisation before they can be diplomatically legalised or Apostilled. For example, private documents issued by ecclesiastical institutions must first be legalised by the Prime Minister’s Office. Documents of guardianship must be intermediately legalised by the Ministry of Human Capacities. Certificates of education must be intermediately legalised by the Ministry of Human capacities, etc.
