The Apostille is a form of authentication that recognizes the legal validity of documents that will be used in other countries. The Apostille legalisation process was created to simplify global certification procedures for documents that were issued in one country but need to be used outside of that country’s territory. Apostille certification takes less time than consular legalisation, and an apostilled document can be used in more than one country unless the requesting country has requirement for Embassy legalisation. If you plan to go abroad for study, work, or take up permanent residency there, you may need to bring your documents with an Apostille seal from the country of issue. Unless countries have reached an agreement to eliminate the document legalisation process, Ukrainian documents must go through the Consular Legalisation to be valid abroad even if they have been Apostilled in Ukraine.
The Ministry of Education and Science of Ukraine, the Ministry of Justice, and the Ministry of Foreign Affairs of Ukraine are the authorities that have the legal power to issue Apostille certification in Ukraine. The Ukrainian Ministry of Education and Science has the authority to apply an Apostille to public records in the fields of science and education. Apostilles are issued by the Ministry of Justice of Ukraine only for documents issued by Ukrainian justice authorities and courts, as well as documents prepared by Ukrainian notaries. Apostilles for any other documentation is issued by Ukraine’s Ministry of Foreign Affairs.
According to the rules, the apostille can be affixed to the following documents:
– Vital Records (Ukrainian certificates of Birth and Death, Marriage, and its dissolution)
– Documents that were drawn up by notaries of Ukraine. Power of Attorney, Letter of Consent, etc.
– Court certificates and any other documents issued by Ukrainian Courts
– Official papers issued by the State authorities of Ukraine
– Identity cards and Criminal Record Certificates
– Employment Record Documents
– Passport documents (migration card, registration)
– Technical passport (vehicle registration certificate)
– Military ID.
– The country of issue must be a member of the Hague Convention
– The document must not be in any way amended
– Most of the original Ukrainian documents must be certified by previously mentioned Ukrainian government authorities or Notary Public
– The document cannot be written or signed in pencil or faxed as a copy
– The document must not contain unspecified corrections or text additions
– Any documents that do not have an official seal of establishment or the signature of the head of a specific department will not be taken into consideration

Additional legalisation may be required when documents are used in countries that are not members of the apostille convention even though they have been properly legalised by Ukrainian Apostille. Said documents will also need to be legalised by the relevant Embassy in this case. A Ukrainian birth certificate, for example, would need to be legalised with an apostille and stamped by the embassy before being used in UAE.
