WHAT IS AN APOSTILLE AND HOW APOSTILLE LEGALISATION IN AUSTRIA DIFFERS FROM OTHER COUNTRIES?

Legalisation confirms the authenticity of the signature and the authority of the issuer of a document. It is carried out by the consular officer of the state in which the document is to be used. For documents from many states, legalisation is not required reciprocally based on international treaties, or it is replaced by the “Hague Apostille”. An apostille is a rectangular stamp containing the inscription “Convention de La Haye du 5 octobre 1961” in French. The stamp indicates whose signature the apostille authenticates and contains the date and the identification number of the apostille. Austria is fully compliant with the Haye convention and any documents with an Austrian apostille are accepted abroad.

HOW TO GET AN APOSTILLE IN AUSTRIA?

An Apostille can only be issued for an original document. The document must be in an acceptable condition and all stamps and signatures must be legible and intelligible. Furthermore, it must not contain any notes and annotations by a third party. The apostille is issued by a designated authority of the state by which the document was issued and does not require any further confirmation. WHAT IS A CONSULAR LEGALISATION IN AUSTRIA?

The legalisation of documents is only required between states that have not entered a  bilateral/multilateral agreement regarding legal transactions involving certificates and similar documents. Legalisation confirms the authenticity of a document (more specifically the authenticity of the signature on the document and the attached seal). Before legalisation can be carried out by the competent Austrian representation authority (BMEIA) abroad, the document must be authenticated by the consular officer of the country in which it is to be used. The documents are presented to the Consular Section of the Ministry of Foreign Affairs, where they confirm the authenticity of the stamp and signature previously received by the competent authority, with the seal and signature of an authorised employee of the Ministry of Foreign Affairs. At the embassy of the country for which the document is issued, the signature of the competent official of the Ministry of Foreign Affairs and the imprint of his or her seal are verified. If everything is in order, another confirmation stamp appears on the translation of the document.
